Kapsch TrafficCom subsidiary secures €27m settlement in German passenger vehicle toll dispute

The proceedings stemmed from the cancellation of a contract related to the automatic enforcement system for Germany’s planned infrastructure charge on passenger vehicles – widely known as the passenger vehicle toll — which was abandoned in 2019 after a ruling by the European Court of Justice.
According to Kapsch TrafficCom, the settlement will be finalised by the arbitral tribunal in the coming days.
Once executed, all reciprocal claims concerning the planning, development, construction, operation and maintenance of the automatic control system will be considered resolved.
In light of the expected settlement inflow, the Vienna-based ITS company has updated its outlook for the 2025/26 financial year.
It continues to anticipate revenues of around €510m with an operating result (EBIT) of approximately €45m, while acknowledging the potential for further positive one-off effects over the course of the year.
Kapsch said the settlement provides it with greater financial clarity following years of legal uncertainty surrounding the cancelled German passenger vehicle toll, which had been a politically controversial infrastructure charging initiative.
